Priest convicted of child molestation may be deported

DALY CITY, California - The girl who had an intimate relationship with a Filipino priest convicted of child molestation is finally speaking out.
Father Jose Superiaso may have served his time in prison, but the girl said the community should remain vigilant.
The Filipina, who did not want to be identified, said she was in her 20s and a youth coordinator for the church when she began a sexual relationship with Superiaso in the 1990s.
She described Superiaso as an "enigma," articulate and charismatic.
The affair started when she confided in Superiaso that she had been molested in the past by a priest in the Philippines. Superiaso, she said, took advantage of her vulnerability.
“He was the keeper of my secret and then

To her utter shock, she discovered that Superiaso was also having a sexual relationship with her much younger sister, who was then only 12 years old.

She and her family reported the priest to the police.
Superiaso was arrested and pleaded guilty to child molestation in 2005. He was sentenced to 10 years in prison.
Last January 24, he was finally released. Since he is not a US citizen, he was immediately turned over to immigration authorities and is now in deportation proceedings.
Concerned, she wrote a letter to the Archbishop of Manila, saying: "I beg you to ensure the safety of children and vulnerable adults by preventing Superiaso from continuing to minister in Manila or any other part of the country.”
Another Filipino, a former parishioner who also refused to be identified, said he was a good friend of Superiaso and defended him prior to his guilty plea.
While he agreed that Superiaso should not be allowed to return to priesthood in the Philippines, he said the priest should be forgiven.
"Even though he was accused of doing something wrong, he still has faith in the Church and Christ. I believe that he will be a changed person. I hope for the best,” he said.
US immigration officials said it would take about two months for the judge to decide on Superiaso’s deportation to the Philippines.

Gabriela calls on Butuan Bishop to stop coddling priest charged with rape of minor

Gabriela said the CBCP should issue specific directives to Bishop Juan de Dios Pueblos to stop coddling the accused priest. It also welcomed the statement earlier made by Archbishop Emeritus Oscar Cruz, head of the Catholic Bishops National Tribunal of Appeals, that it is the duty of the Diocese of Butuan to commence Cabonce’s trial under canon law.

MANILA — Stop protecting the priest who allegedly raped 17-year old Leah.
This was the demand issued by activist women’s group Gabriela to Butuan Bishop Juan de Dios Pueblos after the latter admitted that Fr. Fraul Cabonce was under his custody. Cabonce is the parish priest of St. Anne Parish in Tubay, Agusan del Norte. He is being accused by a 17-year old high school graduate for sexually abusing and raping her while she was under his supposed care as a scholar of St. Anne Parish.
The victim, “Leah” came out earlier last week to expose Cabonce, saying that from September 2010 to April 2011, the priest subjected her to various forms of sexual abuse including forced oral sex and rape. Leah and her parents sought the help of Gabriela to help secure justice for the minor. The victim herself said she is determined to see the alleged perpetrator punished not only because of what he did to her, but because she wants him stopped from repeating the abuse to other children and women.
With the help of Gabriela, Leah filed charges of rape, acts of lasciviousness and child abuse against the priest last August 25.
According to Gabriela spokesperson for Caraga Atel Hijos, Cabonce has been temporarily relieved of his duties as parish priest and reassigned to the Bishop’s Palace in Caraga by Bishop Pueblos. The move has been met by protests from Leah’s supporters.
Gabriela secretary-general Lana Linaban said by taking Cabonce into his custody and deciding to merely transfer him to another parish, Bishop Pueblos is condoning the abusive act committed against Leah. “What the Bishop is doing is in violation of criminal laws and the law of the Church,” she said.
Linaban said Bishop Pueblos should surrender the alleged rapist to state authorities and let him face the criminal charges filed against him.
“Church authorities should also begin the process of trial against Cabonce under the Church Tribunal,” she added.
Members of the media in Butuan attempted to interview Pueblos but the bishop refused to comment on the issue.

Pueblos is the same bishop who admitted that in 2009, he asked former president Gloria Macapagal-Arroyo for a brand new vehicle for his 66th birthday. It was subsequently exposed that the car – a Mitsubishi 4×4 Montero – was bought using funds from the Philippine Charity Sweepstakes Office. He admitted that he wrote a letter to Arroyo about his birthday gift and said it was unfortunate that his “shortcoming” was his “zeal.”
“My actions have been misconstrued . . . cast a shadow of uncertainty on my dignity and moral ascendancy as a bishop,” said Pueblos who stressed that it was “service to the public” that motivated him.
During the July senate blue ribbon committee investigations, a letter from the bishop addressed to the former president was read, and in it, Pueblos requested that he be given a “brand new 4×4” for his 66th birthday. He explained in the same letter that he needed the vehicle to help him go to the far-flung areas in his province.
Pueblos also said that he was using a seven year-old car that was no longer in good running condition.
In the same hearing, PCSO Chairperson Margarita Juico confirmed that the check issued for the purchase of the vehicle was paid to the diocese of Butuan and not to Pueblos.
Six other prelates besides Pueblos were discovered to have acquired vehicles during the Arroyo administration using P8.258 million from the PCSO. The vehicles have since been turned over to the charity agency last month.
The other prelates are Bishop Pueblos of Butuan, Archbishop Romulo G. Valles (Zamboanga), Archbishop Orlando B. Quevedo (Cotabato), Bishop Leopoldo C. Jaucian (Bangued, Abra), Bishop Martin Jumoad (Isabela, Basilan), Bishop Rodolfo F. Beltran (Bontoc) and Archbishop Ernesto Antolin Salgado (Caritas Nueva Segovia).

Gabriela reiterated its call for the Roman Catholic Church hierarchy and specifically the Catholic Bishops Conference of the Philippines (CBCP) to take necessary steps to ensure that Leah gets the justice she deserves. The group said the CBCP should issue specific directives to Bishop Pueblos to stop coddling the accused priest. It also welcomed the statement earlier made by Archbishop Emeritus Oscar Cruz, head of the Catholic Bishops National Tribunal of Appeals, that it is the duty of the Diocese of Butuan to commence Cabonce’s trial under canon law.
Cruz declared last weekend that under canon law, cases which involve the welfare of minors are considered grave and serious and should be sent for trial and judgment to the Vatican in Rome. The Vatican is the seat of the Roman Catholic Church.
Cruz told the media that the bishop supervising the accused priest should gather criminal evidence, specifically testimonies and documentary regarding the case. If the bishop discovers that the case has preliminary merit, then the case should be sent to Rome.
“If the bishop concerned doesn’t want to gather the preliminary evidence himself, then he should assign one of his priests or his tribunal personnel to do it,” he said.
Cruz said in reports that this latest controversy is “a very big scandal” that causes the Church great shame and that the diocese cannot afford not to act on it. He also said that the priest being accused in this case should be tried before a criminal court and that if found guilty, he should be made to serve a life sentence. In the meantime, the priest ,Cruz said, should also be made to stand trial in front of the Church and if found guilty, should be dismissed from all clerical duties.
“In the diocese fails to act, the National Tribunal of Appeals could not interfere unless directed to do so by the papal nuncio,” he said.
Cruz explained that under ordinary circumstances, a case is presented for resolution to the Tribunal of First Instance. This tribunal has an office in all all dioceses and archdioceses all over the country. If a complainant is dissatisfied with the tribunal’s decision, then he or she can appeal it and the case will be elevated to the National Tribunal of Appeals. If the complaint remains unsatisfied, then the case will go to Rome.
The special circumstances of the victim and complainant in this case being minor, however, makes the case sensitive. “The Holy See has automatic jurisdiction over the case, ” Cruz said.
Gabriela’s Linaban said not only does Leah’s case negatively impact on the Church, but it is also a serious offense both against the Church and the law. “No cover-up should be allowed to take place and deny the victim justice. Justice should be blind to age, stature or religion and it should be given to Leah and all the victims of rape in this country and every where else in the world,” Linaban said.

I am forwarding my sworn statement that was sent to Congregation for the Doctrine of the Faith on June 13, 2006 concerning the Diocese of Naval and it’s Bishop, Most Rev. Filomeno G. Bactol, D.D.
We have received no acknowledgment from this statement and our follow up letters to the Cardinal Prefect William Joseph Levada have not been acknowledged.
In this sworn statement that was signed in the presences of Most Rev. Paul Coakley, Bishop of Salina, Kansas, USA and witnessed by Rickey Vice, MBPH, and the Mayor of Ogden, Kansas, Wayne Henson, to express the serious nature of this statement.
This sworn statement was signed in view of THE CRIME OF FALSEHOOD (Cann. 1390 - 1391.
We believe that these charges against the Bishop Bactol and the Diocese of Naval are of serious matter:
Allowing violations of the moral law of the Catholic Church (Canon 1389). This includes violations of celibacy (Canons 1394, 1395).
Can. 1387 A priest who in the act, on the occasion, or under the pretext of confession solicits a penitent to sin against the sixth commandment of the Decalogue is to be punished, according to the gravity of the delict, by suspension, prohibitions, and privations; in graver cases he is to be dismissed from the clerical state
Can. 1385 A person who illegitimately makes a profit from a Mass offering is to be punished with a censure or another just penalty.
Can. 1389 §1. A person who abuses an ecclesiastical power or function is to be punished according to the gravity of the act or omission, not excluding privation of office, unless a law or precept has already established the penalty for this abuse.
§2. A person who through culpable negligence illegitimately places or omits an act of ecclesiastical power, ministry, or function with harm to another is to be punished with a just penalty.
We believe that if the Roman Catholic Church refuses to investigate these and other charges, the Church is approving of such behavior and endorsing it. Therefore losing moral authority.
We pray that your office will bring about justice for our Community and most of all justice for the people of the Diocese of Naval.

I, Stephen M. Greinke, being of legal age, a member of the Roman Catholic Church, swear and declare before Almighty God the following facts and statements, under penalty of Law, Civil Law, and Canon Law (Canons 1390 - 1391) of the Roman Catholic Church.
I have served as President / Superior of a Private Association of the Christian Faithful called the Society of the Missionary Brothers of Perpetual Help from 1990 to the present. Founded in the State of Washington 1989 and accepted into the Diocese of Naval, in September 8, 1990 when invited by Most Rev. Filomeno G. Bactol, D.D. Bishop of Naval to come to his newly created Diocese as an Apostolic Union.
The Missionary Brothers received little or no spiritual and financial help from Bishop Bactol and the Diocese of Naval during our 13 years of belonging to the Diocese of Naval.
I was told by the Vicar General of the Diocese of Naval, that the only reason I was asked to come to the Diocese of Naval was to be A SEXUAL PLAY THING for the Bishop of Naval. I was also told by several priests of the Diocese, that the priest advisors where not consulted on my being invited to be a vital part of the Diocese as decided by the Bishop.
From the very beginning I witnessed Bishop Bactol sleeping with young under age boys under the age of 16, in his bedroom at night. I knew it a bad idea for the Bishop to leave himself open to scandalous gossip among the townspeople. I had frequently told him this when I served as his secretary for 6 months. His response was always “ I need the boys around me at night”.
Priests in the Diocese would make jokes about the Bishop’s homosexual conduct and said these where their aces, if they would get in trouble with the Bishop.
I openly heard a parent talking about having his two young boys having had sex with Bishop Bactol and was happy that the Bishop was paying for their education as there reward for having sex with him.
After 6 months of living at the Bishop’s Palace I wanted to move out and begin the Brother Community that the Bishop had offered and approved..
In the beginning, of the MBPH Monastery I reported to the Bishop that I witnessed some of the Brother Candidates masturbating each other. I reported this directly to the Bishop and he said that was part of the Filipino culture and that “you Americans don’t understand our Filipino culture“.
Another time I was informed that the some of our candidates were receiving money from a priest of the Diocese of Naval. They said they where being paid by the priest to have sex with him. This same priest served as our first confessor to our community. (Violation of Canon 1387) I went to Bishop Bactol and informed him that it was not right for the priest to hear the confessions of his victims of sexual abuse. The Bishop did not do anything about it. I finally objected to this priest hearing confessions at the Monastery. With the Bishop knowledge and approval, this same priest continued to hear confessions at our Monastery.
It was common knowledge that the senior priest of the Diocese was fathered children by women in the area. When I brought it to the Bishop’s attention, the Bishop stated he had heard there were three children now, I informed him there was four. And the Bishop laughed. This same priest continued public ministry until the day he died.
Immorality was very evident among the priests of the Diocese. Many times our Brother Candidates were witnesses to women sleeping in the same convents (rectories) that our Brother Candidates were staying. Even to the point of a Brgy. Government spying on and bringing to the Bishop’s attention these sexual relations. One of our Brothers had to take over the Church (by request of the Bishop) until a priest could be found to replace the priest who was caught in adultery. Later on this same Brother (in formation) was having sexual relations with a married woman and her child - This Brother had learned this was the way of life in the Diocese of Naval. The people in Naval said if priests can have babies, why can’t Brothers?
Our Chaplain was upset with this Brother about what this Brother was saying about him in public. This priest, in the presence of a Brother Associate, wanted me to pay P5,000 pesos to have this Brother murdered. He was not joking. He told me that he had someone in mind who would do the job. I met to discuss this before our Monastery Community Council. They recommended that I go to the Bishop and report it. I did this and the Bishop was not alarmed, the took no action. I asked if we could have another Chaplain, due to the serious nature of this. The Bishop said “no“.
In May of 1997 our MBPH Community place $2.000 in the Diocese of Naval Social Action account with the chancery. This was the Misso Money for building our church (grant money). Our Chaplin told us that we would get it back in September of that year. When that time had passed the money was gone. I went to the Bishop, the Bishop told me that that money was gambled away. The Bishop told me to raise Mass Stipends from the USA to pay off the debt that was owed by the Diocese. The priests would say the masses, and we keep the money. I could not accept using mass money in this improper way.
Sometimes the priests would use 10 mass stipends at one mass and then keep the money.
Getting Mass stipends was a big business with the priests of the Diocese. Sometimes it was told to the people that without an stipend - no mass!
I bring these and other charges against Most Rev. Filomeno G. Bactol, for the purpose that this Bishop has shown little spiritual leadership to the people of the Diocese, that he is a poor role model for priests and religious of the Diocese of Naval. That this Bishop with his immoral lifestyle is a public scandal to the Church. That said, the Bishop needs to be replaced for the good of the Church.
I again call for removal of Most Rev. Filomeno G. Bactol, DD, and that the Holy See appoint a worthy Bishop for the people of the Diocese of Naval and a worthy role model for the priests of the Diocese. I believe that Bishop Bactol has abused his authority as Bishop through negligence. Allowing violations of the moral law of the Catholic Church (Canon 1389). This includes violations of celibacy (Canons 1394, 1395).

In May of 1997 our MBPH Community place $2.000 in the Diocese of Naval Social Action account with the chancery. This was the Misso Money for building our church (grant money). Our Chaplin told us that we would get it back in September of that year. When that time had passed the money was gone. I went to the Bishop, the Bishop told me that that money was gambled away. The Bishop told me to raise Mass Stipends from the USA to pay off the debt that was owed by the Diocese. The priests would say the masses, and we keep the money. I could not accept using mass money in this improper way.
Sometimes the priests would use 10 mass stipends at one mass and then keep the money.
Getting Mass stipends was a big business with the priests of the Diocese. Sometimes it was told to the people that without an stipend - no mass!
I bring these and other charges against Most Rev. Filomeno G. Bactol, for the purpose that this Bishop has shown little spiritual leadership to the people of the Diocese, that he is a poor role model for priests and religious of the Diocese of Naval. That this Bishop with his immoral lifestyle is a public scandal to the Church. That said, the Bishop needs to be replaced for the good of the Church.
I again call for removal of Most Rev. Filomeno G. Bactol, DD, and that the Holy See appoint a worthy Bishop for the people of the Diocese of Naval and a worthy role model for the priests of the Diocese. I believe that Bishop Bactol has abused his authority as Bishop through negligence. Allowing violations of the moral law of the Catholic Church (Canon 1389). This includes violations of celibacy (Canons 1394, 1395).

Regarding the person of Stephen Greinke and his Malicious Accusations against the Bishop of Naval.
We, the Clergy, Religious, and Faithful of the Diocese of Naval, would like to express our strongest condemnation of the lies peddled by Stephen Greinke against the Bishop of Naval, the Most Rev. Filomeno G. Bactol, D.D. last January 2. 2008, Stephen Greinke, in a nationally televised network, accused the bishop of sexually molesting young boys. We are aghast at this accusation because the Bishop is a person of integrity, whose ministry of 40 years (15 years in the seminary as formator 7 years as Pastor, and 18 years as Bishop of Naval) has never been enmeshed in any controversy, much less scandal. We are appalled even more at the brazenness of Greinke as to impute upon the good name of the bishop the very same crime he was accused of doing against innocent young boys in the very Association he had come to found, purportedly to proclaim the love of God only to find out it has become a trap for his sexual perversion! Such lies therefore that he has concocted can only come from a heart whose hatred is as deep as his own twisted understanding of what is good and moral.
Who is Stephen Greinke?
Stephen Greinke, a U.S. citizen, was a Redemptorist Brother from 1978 to 1979 with temporary vows in St. Louis Province of the Redemptorist Order in the United States of America. He left the Redemptorist Province of St. Louis having let his temporary vows expire. Later who applied for admission to the OAKWOOO Province of the same Order and took vows once again in 1984. Eventually he made his perpetual profession on August 30, 1986.
Apparently, his stay with the Congregation was fraught with difficulties for himself and for others. Hence, he requested for Exclaustration in July 1990. His exclaustration was extended several times. It terminated in the year 2000 when he finally sought and was granted the Dispensation from the vows and obligations of his profession in the Congregation.
In 1990, Stephen Greinke came to apply for work as a Religious Brother in the Diocese of Naval. In effect, he was given an invitation to work in the diocese with a motive of discerning whether a Religious Institute of Diocesan Right can be established in the diocese,:He then organized an Association of Men which he called Missionary Brothers of the Perpetual Help (MBHP) which was temporarily approved by the Bishop in September 8 of the same year.
However, his real motive soon started to manifest. He was accused of sexual molestations from no less than his Own young recruits to the association he founded. On account of these accusations, Stephen Greinke was charged before the Bureau of Immigration and Deportation. (BID). The bureau, considering the gravity of the accusations and upon finding sufficient basis, canceled his Missionary Visa and included his name in the Bureau's list of Blacklisted Aliens in the year 2000 (he was able to leave the country earlier without answering the charges against him). In the same order, the Bureau asserted that his non-appearance at the Bureau was deemed a waiver on his part to face the charges, and that on account of this, he was so "ordered deported to his country of origin."
His relationship with the people in Sitio Lupa (where his formation house was located) and in the two neighboring barangays of Calumpang and Caraycaray, all in the Municipality of Naval were always strained and fraught with difficulties. Ill tempered and ever so vindictive, Stephen Greinke would always threaten to haul people to court whenever he was provoked or whenever things would not be according to his liking. Indeed, there were a number of times when he succeeded in bringing poor people to jail and old women as well, on some unfounded charges! Not able to take it any longer, the residents of Barangay Caraycaray and sitio Lupa wrote resolutions letters declaring Stephen Greinke persona non grata and attached the Same documents to the petition of the people at the BID to have him deported.
Meantime, the clergy of the diocese saw that the community that Stephen Greinke established had gone morally and spiritually bankrupt. Not only that, it had also caused much harm, division, and undue pain among the people living nearby. That was when the clergy of the Diocese made a Resolution requesting the Bishop of Naval to dissolve and suppress the community that was recognized by the diocese. In response, the Bishop the issued a decree of Dissolution /Suppression in July 2003.
While in the United States, Greinke wrote letters accusing the Bishop and the Clergy of wrong doings, maligning their good names. One such letter was addressed to the late Holy Father John Paul II. Because of this, a Visitation and Investigation was made on the Clergy and the Bishop of Naval by the Most Rev. Jose S. Palma, D.D., then Bishop of Calbayog. The then Metropolitan Archbishop of Palo, Most Rev. Pedro R. Dean Jr., D.D., also conducted his own investigation (the Bishop of Naval being his suffragan) and refuted point by point the accusation hurled by Greinke against the Bishop and the Clergy of Naval.
Several "demolition" letters have been written by Stephen Greinke, the last being on March 2005. All these letters contained the same sweeping rehashed allegations that were substantially deceitful and which Church authorities have found to be false and without basis.
Not content until the Bishop and the clergy fall, Greinke intensified his attack this time using the internet and the media in his vendetta.
Why the unabashed hatred for the bishop and the clergy? For several reasons. One, Greinke felt aggrieved when the bishop refused to defend him when he was accused of sexual molestations that eventually led to his leaving the country. Two, the cancellation of his Missionary Visa by the BID was for him a bitter pill to swallow, and three, he felt offended when his Pious Union was suppressed and dissolved by the Bishop. This meant he could not solicit funds anymore from benefactors since his mission is already non-existent.
Offhand, we have come to wonder why these accusations against the bishop had suddenly resurfaced after these had been dealt with appropriately and expeditiously by the Church authorities years ago. We wonder because there are indications that this move to vilify the Bishop could have been also politically orchestrated by people who cannot stand the teachings of the Church. The strong adherence of the church for good governance and her vehement opposition to corruption have been the bane of many whose lives are hinged on compromises and pay-offs, to the detriment of the poor which comprise majority of God's people. If these indications are so, then Stephen Greinke has just become a dispensable pawn in the bigger picture of dirty politics. The smear campaign against the Bishop has just demonstrated how wicked can people go just so they could preserve their political interests.
THE MOST REV. FILOMENO G. BACTOL, D.D. HAS BEEN UNJUSTLY MALIGNED. HIS REPUTATION HAS BEEN UNJUSTLY TARNISHED. AND THE WORLD HAS BECOME THE UNSUSPECTING AUDIENCE OF THIS MALICIOUS CAMPAIGN AGAINST HIM AND THE INSTITUTION HE REPRESENTS.
We desire to make right what bas been undeservedly imputed to the Bishop. We wish to make it known that the Most Rev. Filomeno G. Bactol, D.D. is innocent of the charges hurled against him. We know because we were victims, one way or another, of his depraved presence in our community years ago.
